VA disability benefits are monthly payments made to veterans, and, in some cases, their families when he or she can show that their disability is related to an injury or event during their time of service. The disability payments, known as their “disability rating”, are based on the degree of the current disability (from 0%-100%).   • An effective date review in Veteran Appeals refers to a review of the date from which a veteran's entitlement to benefits should begin. When a veteran files a claim for disability benefits, the Department of Veterans Affairs (VA) assigns an effective date, which is the date from which the veteran's entitlement to benefits should begin. Quite often, the VA makes a mistake with the effective date. For example, the VA may have delayed processing the claim, resulting in a later effective date than the veteran believes is appropriate or the effective date should be earlier based on new evidence or a re-evaluation of their case.

    Veteran Legal thoroughly reviews every win to ensure the correct effective date and, consequently, the maximum backpay for the veteran. If we find a discrepancy, we will appeal the effective date to the VA with appropriate evidence/legal arguments and monitor the case closely. If the VA determines that the effective date should be earlier than previously assigned, they will provide the veteran with retroactive benefits to cover the period from the new effective date.

  • TDIU stands for "Total Disability based on Individual Unemployability," which is a benefit program for disabled veterans who are unable to secure or maintain employment due to their service-connected disabilities. To be eligible for TDIU benefits, a veteran must have a service-connected disability or disabilities that prevent them from maintaining substantially gainful employment. In addition, the veteran's disability rating must meet certain thresholds, such as being rated at 60% or higher for a single disability, or 70% or higher when considering multiple disabilities.
